Resident Management Company Director Responsibilities - Innovus

Written by Innovus | 30 October 2023

Resident Directors are members of their development’s Resident Management Company (RMC).

They are volunteers appointed by their fellow property owners to help manage and maintain buildings and ensure compliance with the obligations of the deeds or lease for each home.

They decide how best to achieve this, either by self-managing or by appointing a professional managing agent.

Directors also make decisions that will benefit the entire community. They oversee how service charges are spent to look after the development, as well as creating plans for the future.

They also have a duty to comply with a range of health and safety regulations and legal obligations that protect everyone at the development.

Responsibilities include:

  • Follow the RMC’s rules as laid down in its Memorandum and Articles of Association.
  • Maintain statutory company records, report any changes, and ensure all mandatory returns are filed with Companies House and HMRC.
  • Approving the annual service charge budget.
  • Ensure compliance with all relevant health and safety and fire risk legislation.
  • Make sure they have the correct insurance, to protect themselves and the development.
  • Ensure that the obligations of the title documents are carried out by the managing agent.

We work with over 1,700 Resident Management and Right to Manage Companies so we fully understand that staying compliant with ever-changing laws and regulations is vitally important but can be challenging for directors.

Becoming a resident director is a great opportunity to get more involved with the decisions about your development, support your neighbours, and help make sure your community is a great place to live.

So, if you’re interested in finding out more about the role, or need support for your existing RMC, get in touch with us today to see how you can make a difference.
