What is Right to Manage?

Right to Manage is a legal right that allows leaseholders to take control of their building's management without having to prove fault by the landlord or pay compensation. This means you can choose your own property management arrangements, control service charges, and make decisions about your building's maintenance and services.

Who qualifies for RTM?

To qualify for RTM:

  • Your building must be self-contained
  • At least two-thirds of the flats must be held by qualifying tenants (leaseholders with leases originally granted for more than 21 years)
  • At least 50% of leaseholders must agree to participate
  • The building must be primarily residential (no more than 25% commercial space)
  • The building must contain at least two flats
How long does the process take?

An uncontested RTM application typically takes between 5-6 months from start to finish. This includes:

  • Formation of the RTM company
  • Service of statutory notices
  • Notice periods required by law
  • Transition period to new management arrangements The timeline may extend if the application is contested by the landlord.
What are the costs involved?

Our RTM service operates on a fixed-fee basis, which includes:

  • Formation of the RTM company
  • Land registry searches and disbursements
  • Service of all statutory notices (including postage)

What happens after RTM is granted?

Once RTM is granted:

  • Your RTM company takes control of building management
  • You can appoint your chosen managing agent
  • You gain control over service charges and maintenance decisions
  • The landlord remains the freeholder but has no involvement in management
  • Ground rent continues to be payable to the landlord
  • The RTM company becomes responsible for enforcing lease covenants and maintaining the building
